ITIN for Non-Residents: W-7 Eligibility and Documentation
Check W-7 eligibility, return exceptions, required identity documents, CAA and IRS routes, processing guidance and the limits of an ITIN.

An ITIN (Individual Taxpayer Identification Number) is the 9-digit tax ID the IRS issues to foreign individuals who have a US tax filing obligation but are not eligible for a Social Security Number. For non-resident LLC owners, ITINs are widely misunderstood — most people who think they need one actually don't, and most who do need one apply for it the slow, expensive way. This guide walks through exactly when you need an ITIN, the full Form W-7 application, the CAA vs. direct-to-IRS routes, realistic 2026 timelines, the rejections that send applicants back to square one, and what an ITIN does (and does not) do for your US banking.
ITIN vs. EIN vs. SSN: which one do I actually need?
The three IRS-issued tax identifiers look similar on paper but cover completely different use cases. Mixing them up is the single biggest source of wasted weeks and rejected paperwork for non-resident founders.
- SSN — issued by the Social Security Administration to eligible individuals, including some noncitizens.
- Do not infer eligibility solely from living abroad.
- EIN — a business identifier used for the LLC’s federal tax administration. ITIN — an individual identifier for a qualifying federal tax purpose when the person is not eligible for an SSN; it does not grant work or immigration rights. Further reading: EIN for non-residents
A useful mental model: the EIN is for your LLC, the ITIN is for you as an individual. An ITIN does not authorize you to work in the United States, does not grant any immigration status, and does not entitle you to Social Security benefits or the Earned Income Tax Credit. It exists for one purpose: to let the IRS track a foreign individual's US tax filings.
Who actually needs an ITIN as a non-resident LLC owner?
Apply for an ITIN only if you are not eligible for an SSN and have a federal tax purpose qualifying under the W-7 instructions, usually a return or a documented exception. LLC ownership, a credit-card request or a bank preference alone does not establish eligibility.
- Partnership interest: a nonresident individual partner may need an ITIN for personal reporting or withholding; foreign entity partners use their appropriate tax IDs.
- Corporate payments: dividends, salary and other income have different return and withholding rules—an election alone does not automatically require an ITIN.
- US-source personal income: assess return obligations and withholding exceptions.
- Treaty claim: Form W-8BEN can require a US or foreign tax identification number depending on the claim and exceptions.
- Spouse or dependent: follow the restricted W-7 eligibility rules.
- US real estate disposition: review FIRPTA and documented W-7 exceptions.
US tax is not determined by the absence of an office alone. A single-member LLC is generally disregarded unless it elects corporate taxation, but the owner may owe US tax on effectively connected income (ECI) or US-source fixed, determinable, annual or periodical (FDAP) income. FDAP is generally subject to 30% gross withholding unless a treaty or other rule reduces or removes it; ECI is generally taxed on a net basis. Home-country treatment depends on local law, entity classification and treaty relief, not a universal rule that every owner always pays tax at home. A foreign-owned US disregarded entity must file Form 5472 attached to a pro forma Form 1120 for a year with reportable related-party transactions. Owner contributions, distributions, loans and payments can qualify, including formation funding with zero revenue. Review each tax year separately: a prior formation contribution does not itself create a transaction in every later year. Other classifications and filing exceptions require separate analysis. The LLC’s EIN is separate from the owner’s ITIN; the filing review does not itself settle ITIN eligibility. Further reading: Form 5472 with a pro forma 1120
Bottom line: don't apply pre-emptively. Form the LLC, get the EIN, open the bank account, and only pursue an ITIN once a return, withholding form, or treaty claim actually requires one.
Form W-7 line-by-line walkthrough
Form W-7 is the IRS application for an ITIN. It looks short — one page, front and back — but the fields are precise and the IRS rejects W-7s for mistakes that are almost invisible unless you've filed one before.
Reason for submitting (top of form)
Choose the reason box or permitted combination specified in the instructions. Some treaty applicants must use more than one applicable reason box; do not follow a blanket “exactly one box” rule.
- Reason boxes — select the applicable box or permitted combination and document any return exception exactly as the W-7 instructions require.
- Treaty claims can involve box (a), a return-related reason, the treaty country and article.
- Do not assume box (h) and a generic exception label are always sufficient.
Name, mailing address, foreign address (lines 1a–3)
Use the name exactly as it appears on your passport. If your passport shows "GARCIA LOPEZ, JUAN CARLOS," your W-7 must read the same way. Line 2 (mailing address) can be a US address — including your US registered agent — but line 3 (foreign address) must be your actual residential address abroad. A foreign mailing address that matches your foreign home address on line 3 is fine.
Birth information (lines 4–5)
Country of birth + date of birth + country of citizenship. Match your passport biographic page.
Other information (lines 6a–6g)
- 6a — Country(ies) of citizenship.
- 6b — Foreign tax ID number. Your home-country tax ID (e.g., UTR, CPF, RFC, NIE). Leave blank only if your country does not issue one.
- 6c — Type of US visa, number, and expiration date. Leave blank if you've never held a US visa.
- 6d — Identification documents. Almost everyone uses "Passport" here — it is the only standalone document the IRS accepts. Enter the passport number, country of issue, and expiration date.
- 6e–6f — Prior ITIN or IRSN. "No / N/A" unless you've previously been issued one.
- 6g — Name of college / university / company (only for box f applicants).
Signature
Sign in pen, date in MM/DD/YYYY US format, and include a daytime phone number with country code. Unsigned W-7s are auto-rejected.
CAA route vs. IRS direct: which one should you use?
The W-7 instructions permit mail, designated Taxpayer Assistance Centers and acceptance agents. Document-return arrangements differ; using a center or qualifying CAA can avoid sending eligible original documents to the IRS, but not every document can be authenticated through every route.
Option 1: Certifying Acceptance Agent (CAA) — recommended
A Certifying Acceptance Agent can authenticate eligible identification documents and submit the required certificate under IRS procedures. Confirm which originals the CAA must inspect, how the interview is conducted and what it can certify; a video call alone is not a substitute for required original-document review. Obtain a written fee quote. This article has no verified comparative acceptance-rate or faster-processing study.
Option 2: Mail to IRS Austin (direct, free)
You mail the original W-7, the attached tax return, and either your original passport or a copy certified by the issuing authority (your country's passport office) to:
Internal Revenue Service, ITIN Operation, P.O. Box 149342, Austin, TX 78714-9342, USA.
Mailing to the IRS has no application fee, but postage and replacement-document costs can apply. Use original documents or copies certified by the issuing agency as the instructions permit. Ordinary notarization or an apostille is not automatically equivalent to issuing-agency certification; confirm special exceptions and availability with the issuing authority.
Option 3: IRS Taxpayer Assistance Center (TAC) — US only
If you are temporarily inside the United States, you can book an appointment at a designated IRS TAC, present your passport in person, and walk out with it the same day. Free, but only practical for non-residents who happen to be visiting the US.
Compare the CAA’s quoted fee and document-authentication scope with direct mail and a designated TAC appointment. A CAA can help organize documents, but cannot guarantee IRS approval or a shorter processing queue. If you need your passport soon, resolve the document-return route before mailing.
2026 ITIN timeline: realistic week-by-week expectations
- The IRS advises allowing about seven weeks for an ITIN application, or nine to eleven weeks during peak tax season or when applying from overseas.
- Mailing time, additional information requests and IRS workload can extend this.
- A CAA does not create a guaranteed expedited queue.
- Respond to any notice by its stated deadline.
The IRS issues your ITIN on a CP-565 notice, which is mailed to the address on line 2 of the W-7. Keep this letter — it is the only official document showing your ITIN, and banks, brokers, and CPAs will ask for it.
Common ITIN rejection reasons
- Missing tax-purpose evidence — attach the required federal return unless a documented W-7 exception applies.
- Insufficient document authentication — use original documents or copies certified by the issuing agency under the instructions; ordinary notarization or an apostille is not automatically sufficient. Confirm any special permitted exception.
- Name mismatch. The W-7 name doesn't match the passport name (missing middle name, swapped surname order, or use of a "preferred" name).
- Wrong reason box. Checking box (b) "filing a US tax return" but not attaching one, or checking box (h) "other" without writing the specific exception.
- Expired identification — the IRS requires documents current at submission. Respond to a later IRS request if additional current evidence is needed; no unsupported few-weeks rejection rule is asserted.
- Missing foreign address. Line 3 cannot be a US address — even if you live in the US temporarily, the IRS wants your home-country residential address.
- Applying without a qualifying tax purpose — use a return or the permitted documented exception. Do not assume every valid exception must wait until the tax year ends.
Banking implications: does an ITIN open more doors?
A US LLC and EIN can support a banking or processor application, but do not ensure acceptance. Each provider reviews owner country, industry, identity, addresses, business activity and source of funds. Remote onboarding is possible only where the provider permits it; approval time, account details and fees vary. Check the provider’s current eligibility before paying for formation solely to obtain an account. An ITIN is not universally required for an LLC business account and is not a substitute for provider eligibility. Further reading: US business bank account guide
Where an ITIN does change what's available:
- Personal banking: ask the institution about identification, residence and branch requirements; an ITIN does not guarantee an account.
- Credit cards: issuers set ID, residency and credit requirements, and wanting a card does not qualify you for an ITIN.
- Brokerage accounts: eligibility and documentation depend on country, product and provider.
- Treaty withholding: the required W-8 form and tax ID depend on the beneficial owner and claim; some W-8BEN claims permit a foreign TIN or an exception rather than requiring an ITIN.
ITIN renewal and expiration
ITINs are not permanent. An ITIN expires if it is not used on a US federal tax return for three consecutive years. The IRS also runs periodic batch expirations based on the middle two digits of the ITIN. When yours expires, you renew by submitting a new Form W-7 marked "renewal" — same documentation rules apply. There is no fee from the IRS to renew.
Should a non-resident LLC owner bother?
Determine whether a return or documented W-7 exception requires an ITIN before applying. Do not apply merely because you formed an LLC or want a credit card. Discuss partnership interests, corporate payments, US-source income and treaty claims with a qualified adviser. If an eligible ITIN is unused on federal returns for three consecutive years it can expire.

Frequently asked questions
Do I need an ITIN to own a US LLC as a non-resident?
Owning an LLC alone does not require an ITIN. An individual ineligible for an SSN needs a qualifying federal tax purpose under the W-7 instructions, typically a tax return or a documented exception. Partnership, income and treaty situations need individual analysis.
What is the difference between an ITIN, an EIN, and an SSN?
An SSN is a personal number issued by the Social Security Administration to eligible individuals, including some noncitizens. An EIN identifies a business for federal tax administration. An ITIN identifies an individual with a qualifying federal tax purpose who is ineligible for an SSN.
How long does an ITIN application take in 2026?
The IRS generally advises about seven weeks, or nine to eleven weeks during peak season or for overseas applications. Mailing, workload and information requests can extend this; no CAA-only fast-track is promised.
Can I apply for an ITIN without mailing my original passport to the IRS?
A qualifying CAA or designated TAC can authenticate eligible documents under IRS procedures, potentially avoiding mailing those originals to the IRS. Confirm original-document inspection and which documents can be certified. A video interview alone does not replace required authentication.
Will having an ITIN help me open a US bank account as a non-resident?
An ITIN may meet an institution’s identification requirement but never guarantees banking or credit. Check each provider’s country, residence and document requirements. A bank or credit-card wish alone is not a qualifying W-7 tax purpose.
What is the most common reason an ITIN application is rejected?
Common problems include a missing required return or exception evidence, insufficient identification, wrong reason boxes and inconsistent names. This article has no verified dataset ranking rejection causes. Follow the current IRS documentation checklist.
